يبدأ الكتاب بالحديث عن جريمة الإبادة الجماعية التي تهدف إلى قتل الجماعات أو المجموعة البشرية بوسائل مختلفة وتعتبر من الأعمال الخطيرة التي تهدد أمن وسلامة المجتمع لأنها تؤدي إلى إبادة أو اضطهاد كائنات إنسانية كليا أو جزئيا بسبب طبيعتهم الوطنية أو العرقية أو السلالية أو الدينية وهي ترتكب بصورة عمدية، ولا تنحصر آثارها على الوضع الداخلي للدولة التي تقع في نطاق حدودها الإقليمية، وإنما تمتد حتى إلى الأسرة الدولية بسبب آثارها الشاملة كذلك فهي ليست من الجرائم السياسية، وإنما تعد من الجرائم العمدية العادية حتى وإن ارتكبت بباعث سياسي ثم انتقل إلى الحديث عن أثر الباعث الدافع في المسئولية الجنائية وبين أن الباعث متوفر بكل السلوك الإنساني سواء كان جريمة أو سلوكا اعتياديا فعندما يوجه السلوك لارتكاب فعل إيجابي أو سلبي مخالف لنصوص القانون.
