يتضمن هذا المؤلف قسمين مخصصين للتأمينات العينية والتأمينات الشخصية (الكفالة). فإذا كان التأمين عبارة عن كفالة شخصية ؛ فإنه يكفل للدائن ضم ذمة الكفيل إلى ذمة المدين، بحيث إذا أعسر المدين وعجز عن دفع دينه أو ماطل في الدفع ؛ كان بإمكان الدائن الرجوع على الكفيل اقتضاء لحقه. وإذا كانت الكفالة تضامنية فإنها توفر للدائن ضمانة أكبر تمكنه من الرجوع مباشرة على الكفيل دون أن يكون ملزما بتجريد المدين أو لا، أما إذا كان التأمين عينيا ؛ فإن الدائن يتمتع بحق عيني تبعي على مال معين من أموال المدين، فيكون له بمقتضى هذا الحق أن يتقدم على سائر الدائنين العاديين والدائنين أصحاب التأمينات العينية التالين له في المرتبة في اقتضاء حقه من قيمة هذا المال (عقارا، أو منقولا)، أو من أي مال آخر يحل محله.
