إن من صعوبات تنظيم المسؤولية المدنية عن النشر عبر تطبيقات التواصل الاجتماعي هو القصور التشريعى في تنظيم النشر الالكتروني بشكل عام وعبر تطبيقات التواصل الاجتماعي بشكل خاص، فتطبيق القواعد العامة للمسؤولية المدنية على وقائع النشر عبر تطبيقات التواصل الاجتماعي سيؤذى في الغالبد إلى ضياع حق المتضزر في المطالبة بالتعويض عن الضرر الذي أصابه نتيجة الإساءة إليه أو الاعتداء على حقه في الحياة الخاصة، فمن جانب الخطأ، فالقواعد العامة للمسؤولية قاصرة عن الإحاطة بصور الخطأ في النشر عبر تطبيقات التواصل الاجتماعي، بسبب عدم اعتراف بعضها بالحق في الحياة الخاصة، والحق في الصورة، كما أن تصرفات الأشخاص قد تؤذى إلى صعوبة تحديد مفهوم الحياة الخاضة. ومن جانب الوسيلة المستخدمة، فتطبيقات التواصل الاجتماعي من الوسائل الحديثة في النشر ولم يبين حكمها في التشريعات ولم تحتويها القواعد العامة، فهل يطبق عليها ما يطبق على الصحافة المكتوبة ؟، أو ما يطبق على الإذاعة والتلفزيون ؟، أم ينبغي أن تفرد في تشريع يبين أحكامها وخصوصياتها فى النشر؟.
