يتناول الكتاب حركة التشريع والقانون والقضاء على مدى القرنين الماضيين وأنا لا أقصد بذلك الخصوص السوداني، إنما أشير إلى عموم الحركة الفكرية العربية في أقطارنا كلها وإننا اعتدنا على التأريخ لحركة الفكر في مجالات عديدة، فمنها الفكر السياسي وتطوره والفكر الاجتماعي وندرس تاريخ الأدب والشعر وغير ذلك من مجالات الأنشطة الفكرية أما عن المجال التشريعي والقانوني والقضائي فنجد أن الدارسين يبتعدون في الغالب عن هذا الأمر، ورجال القانون والتشريع يركزون همهم في الدراسات القانونية المتعلقة بالنظرية القانونية وتطبيقاتها ويتابعون الأحكام والفتاوى، أي أنهم يمارسون العمل الفكري القانوني دون إدراك بالحاجة إلى استشراف نظرة تاريخية تظهر الحركة العامة لهذا المجال.
