هي الحالة الاستثنائية التي يتطلب حلها إصدار تشريع خاص يتم من خلال منح السلطة التنفيذية صلاحيات إضافية يتعذر حلها وفقاً القوانين السائدة، وتصدر هذه القوانين عند تعرض بعض الدول لظروف تعتبرها غير إعتيادية (حالة الحرب، الكوارث، الفتن ... إلخ). وتلجأ الدول إلى إعلان حالة الطوارئ وأنها تعرف جيداً أنها تخاطر بالحريات العامة وحقوق الإنسان، إنها تعتبر لجوئها إلى هذا الخيار بحجج كثيرة على رأسها المصلحة الوطنية العليا وسلامة البلد. إلا أننا لو تفصحنا هذه الحجج فإنها لا تعدو في كونها تنصبّ في مصلحة النظام الحاكم وبالأخص مصلحة الرئيس أو الملك.
