Overview
قبل البدء بدراسة مفهوم الجرائم -محور البحث- يحسن بنا أن نعرض لتعريف التجريم بشكل يحدد لنا الإطار العام لهذه الدراسة. فالتجريم لغة : من جرم، أي قطع، وأجرم واجترم بمعنى أذنب فهو مجرم و جريم، واجترم جريمة أي جنى جناية والجرم بالضم الذنب. أما التجريم اصطلاحا Criminalizing فيمكننا تعريفه : بأنه إضفاء اللامشروعية الجنائية على سلوك ما تراه الجماعة مهددا لكيانها بالضرر أو الخطر وتقدر جدارته بالعقاب تبعا لذلك.
