يتناول كتاب (التفاوض على الاعتراف = Plea bargaining) والذي قام بتأليفه د. معتز السيد الزهري في حوالي (100) صفحة من القطع المتوسط موضوع (التفاوض على الاعتراف) الكتاب يتناول نظام التفاوض علي الاعتراف، حيث نشأ في الولايات المتحدة الأمريكية في أوائل القرن التاسع عشر، بعد الحرب الأهلية الأمريكية، حيث كانت تلجأ إليه النيابة العامة دون سند قانوني، معتمدة في ذلك علي الاعتبارات العملية، أي الرغبة في كسب القضية، وعدم ترك المتهم يحصل علي حكم بالبراءة فما لا يدرك كله لا يترك كله، ولم يلق هذا النظام قبولا في بادئ الأمر لدى محاكم الاستئناف، ففي قضية Shelton ألغت المحكمة العليا للولايات المتحدة الأمريكية حكم الإدانة الصادر، بناء على اعتراف، إذ جاء أثر تفاوض النيابة مع المتهم علي الاعتراف علي ارتكاب جريمة إخفاء أشياء مسروقة بدلا من جريمة السرقة، حيث أنه ما لبث التفاوض علي الاعتراف أن يتغلغل في النظام الإجرائي الأمريكي، دون سند تشريعي.
