يدور الإشكال الأساسي لهذه الدراسة حول سؤال : لماذا غاب منطق حقوق الإنسان الطبيعية من الفكر التشريعي الإسلامي ؟ وهذا السؤال يفترض مسبقا ملاحظة هذا الغياب المذكور. كما يفترض أن يكون علم أصول الفقه مجال البحث، وأن تكون نظرية الحق ومفهوم الحق موضوعه وأهمية هذا السؤال تتضح حين يلاحظ أن أساس أزمة حقوق الإنسان في السياق الإسلامي هو عدم الاعتراف بحقوق الإنسان الطبيعية، وأعراض هذه الأزمة بادية مثلا في ذلك التعارض الذي يحدث في أحايين كثيرة بين بعض بنود حقوق الإنسان العالمية والفكر التشريعي الإسلامي السائد.
