الرقابة القضائية هي الآلية والضمانة القانونية التي منحها المشرع للناخب والمترشح لتجسيد ضوابط العملية الانتخابية لضمان حسن سير وشفافية العملية الانتخابية والتحقق من مدى ملائمتها للشرعية وفق قانون محدد ضامن لحرية المشاركة السياسية بدءا من عملية إعداد القوائم الانتخابية إلى غاية الإعلان عن النتائج. لقد أكد المشرع الجزائري هاته الضمانة - الرقابة القضائية - في القانون العضوي رقم 16/10 المتعلق بالانتخابات، الأمر الذي تمخض عنه منازعة انتخابية ذات صبغة خاصة تعلقت أساسا بآجال وطبيعة الحكم القضائي، وهذا كفالة وضمانا للمحافظة على الضوابط القانونية لسير العملية الانتخابية بكل مصداقية وشفافية ترسيخا لمعالم دولة القانون.
