Overview
وقف عدم المشروعية هو نظام وقائي يهدف لمنع أو تصحيح النشاط غير المشروع ليصبح مطابقا للقانون في جميع فروعه، مثل القانون الجنائي والإداري والمدني والتجاري. يركز هذا النظام على العمل ذاته بدلا من آثاره، مما يسمح للقاضي بوقف الأنشطة غير المشروعة حتى دون وقوع ضرر مؤكد، استنادا إلى مجرد خطر الضرر. تتسم دعوى وقف عدم المشروعية بالطابع الموضوعي والإلزامي، حيث يجب على القاضي الحكم بوقف النشاط غير المشروع إذا توفرت الشروط، دون النظر إلى التعويض. تختلف هذه الآلية عن التعويض الذي يتطلب وقوع ضرر لجبره، حيث أن وقف عدم المشروعية يعالج المشكلة من جذورها عبر إزالة العمل غير المشروع، مثل إيقاف الملوثات أو الإعلانات المضللة، بدلا من التعويض عن آثارها.
