Overview
تعتبر المعاملات المالية وإبرام العقود عبر الإنترنت مظهرا من المظاهر الدقيقة للتعاقدات، والتي تزايدت مع انتشار ظاهرة تبادل المعلومات والرسائل عبر شبكة الإنترنت من خلال ما يعرف بالمستندات الإلكترونية غير الورقية؛ فأطلق على هذه التعاقدات وما ينشأ عنها بـ \"التعاقدات الإلكترونية\". ويتميز التعاقد عن طريق الإنترنت بعدة خصائص، من بينها: أنه تعاقد يعتمد على الدعامات اللاورقية في الإثبات، ويتم بالسرعة الفائقة عبر وسيط إلكتروني، كما أنه يسمح بحدوث علاقات غير مباشرة بين أشخاص متعددة، وغير محدد هويتهم، وكذلك يغلب على هذا التعاقد السمة التجارية، كما يتميز بأنه ذو صفة دولية.
