Overview
مرت فكرة العيب الموجب للضمان بتطورات عديدة من حيث تحديد مفهوم هذا العيب بدءا من التشريعات المدنية ومرورا باتفاقية الأمم المتحدة بشأن عقود البيع الدولي للبضائع (اتفاقية فينا) لسنة 1980 وإنتهاءاً بالتشريعات الخاصة بحماية المستهلك، وكان للقضاء الفرنسي دور مهم في تطوير هذه الفكرة لذا جاء هذا البحث لدراسة هذه التطورات مع توضيح موقف القانون العراقي منها وبيان المدى الذي وصلت إليه التشريعات العراقية في الأخذ بهذه التطورات، إذ لم يعد مفهوم العيب يشمل النقص في ثمن المبيع أو ما يفوت به غرض صحيح وإنما توسع هذا المفهوم ليكون أكثر شمولاً مما يسهل فرض الجزاء على المتعاقد الذي يضمن هذا العيب.
