Overview
هناك تنظيم إجرائي خاص للدعوى المستعجلة جنبا إلى جنب التنظيم الإجرائي العام، ومثال ذلك التنظيم الإجرائي المنصوص عليه في قانون التحكيم رقم ٢٧ لسنة ١٩٩٤، والتنظيم الإجرائي المنصوص عليه في قانون المحاكم الاقتصادية. وبناء على ذلك، تعد مسألة الاختصاص في نطاق المسائل المستعجلة والوقتية، ومثال ذلك طلب سماع شاهد أو توقيع الحجز التحفظي في المنازعات المعروضة على هيئات التحكيم المختصة، إحدى المسائل الجوهرية ولذلك، مسألة إصدار القرار في المسائل المستعجلة في نطاق المنازعات المعروضة على التحكيم تثير إشكالية تنازع الاختصاص بين قضاء الدولة المختص وهيئة التحكيم.
