Overview
إن المنازعات والدعاوي القضائية الإدارية تنجم عن علاقات قانونية خاصة تتطلب توافر أنماط فكرية خاصة لدى القاضي الإداري، كما أن الخصوم في الدعوى الإدارية ليسوا متساوين، فهناك الفرد العادي المتضرر من عمل الإدارة، لاعتدائها على حقوقه في سبيل تحقيقها للمصلحة العامة، على حساب مصلحته الشخصية. ومن ناحية أخرى لا بد من وجود سلطة رقابة قوية لقاضي الإلغاء على الشروط الواجب توافرها في الدعوى، حتى يستطيع الفصل فيها ليحقق العدالة ويحمي الحقوق الخاصة للموظفين الإداريين من اعتداء الإدارة عليها، وهو في هذا يحقق نقطة التوازن في الحفاظ على المصالح العامة وحماية المصالح الخاصة.
