Overview
كانت الإدارة مكبلة بكثير من القيود التي تحد من حرية المتعاقدين، فجاء مبدأ سلطان الإرادة ليحررها من تلك القيود، ومن أهم القواعد التي جاء بها قاعدة (العقد شريعة المتعاقدين)، وهذا يعني أن المتعاقدين أحرار فيما يفرضون من شروط وقيود في العقود التي يعقدونها ولا يحول بينهم وبين ذلك حائل، غير أن هذا المبدأ لو أخذ به على إطلاقه لكان له بعض النتائج السلبية وعلى الخصوص عندما تستجد ظروف في أثناء تنفيذ العقد وبعد انعقاده، من هذا المنطلق ترك المشرع للقاضي حق التدخل في تعديل بعض شروط العقد، (وتحديد التزامات أطرافه) في الحدود التي رسمها تفادياً لما يستجد من آثار سلبية، قد تضر بأحد المتعاقدين.
