لقد أثار إنشاء المحكمة الخاصة بلبنان لمحاكمة المتسببين في اغتيال رئيس الوزراء اللبناني الأسبق \"رفيق الحريري\" جملة من التساؤلات تخص سبب إنشائها. ترى هل يعود ذلك إلى قرار مجلس الأمن أم إلى اتفاقية دولية بين لبنان والأمم المتحدة؟ والإجابة عن هذه التساؤلات يحيل بالضرورة إلى دارسة المحكمة الخاصة من حيث تنظيمها وأجهزتها واختصاصاتها.
