Overview
يعد مبدأ التراث المشترك للإنسانية من المبادئ المستحدثة في القانون الدولي، والذي نشأ في رحم القانون الدولي والذي شكل ثورة في المفاهيم القانونية لاسيما في القانون الدولي للبحار، وقد حمل في طياته تطلعات حالمة للدول النامية خاصة، وذلك بأن جعل استغلال المنطقة الدولية التي تحوي موارد طبيعية للإنسانية جمعاء وفق نظام تكافلي، لكن هذا النظام سرعان ما اصطدم برغبة الدول الصناعية الكبرى التي وجدت في اتفاق 28 جويلية 1994 أداة قانونية لنقل المبدأ من مفهومه التكافلي إلى مفهوم تجاري صارم، أعاد المبدأ خطوات إلى الوراء.
