لم تحض مسألة الإشهاد على الطلاق بالبحث المستقل من قبل الفقهاء، وإنما تناولوها بشيء من الإيجاز عند حديثهم عن الإشهاد على الرجعة، والخلاف في درجة مشروعية الإشهاد على الرجعة، هو بعينه حاصل في الإشهاد على الطلاق، فاختلف الفقهاء في حكم الإشهاد على الطلاق هل هو على الندب كما ذهب إليه الجمهور، أم على الوجوب كما نحت إليه طائفة من الصحابة والتابعين والمفسرين، وابن حزم، والشيعة الإمامية. والقول بالوجوب هو الذي تعضده أقوال المفسرين، فضلاً عن روايات متعددة صدرت من بعض الصحابة والتابعين رضوان الله عليهم، كما أنه القول الذي يتسق مع مقاصد الشريعة الغراء، المتمثلة في المحافظة على ديمومة الحياة الزوجية، والحد من التشرد والضياع الذي يلحق بالأبناء جراء الطلاق المتسرع.
