Overview
إن وقف تنفيذ عقد المقاولة يعني وقف الالتزامات العقدية بصورة مؤقته وإدخالها في حالة سبات خلال فترة زمنية معقولة دون المساس بالعقد من حيث الوجود نتيجة حوادث استثنائية عامة تقلب اقتصاديات العقد أو تحول دون الاستمرار بتنفيذه لتعود تلك الالتزامات إلى الحياة والتنفيذ مجددا بعد زوال تلك الحوادث التي يرتجي زوالها والتي تتصف بالتأقيت أصلا، وان وقف تنفيذ عقد المقاولة يحتاج إلى نص تشريعي يمنح المحكمة تلك السلطة، كما أن المحكمة منه المحافظة علي عقد المقاولة من تعديل التزاماته من ناحية كمية وإنقاذه من الفسخ، مع العرض انه يرتكز على قاعدة \"اذا اجتمع المانع والمقتضى قدم المانع، واذا زال المانع عاد الممنوع\".
