Overview
تهدف هذه الورقة إلى تقديم مشروع مقترح للوقف، حيث اشتمل على ثلاث مئة وتسع وخمسين مادة قانونية حوانا من خلالها تغطية الأحكام المتعلقة بالوقف، ابتداء من انعقاده ومرورا بتفسير ألفاظ الواقفين وتحديد آثاره وانتهاء بإثباته، ولا تخرج هذه الورقة عن كونها مجرد مشروع مقترح بجهد فردي- ولأجل ذلك -يبقى قاصرا عن تلبية الطموح وإشباع الحاجة، ولكن يمكن الاستفادة منه أو من بعض مواده واعتباره منطلقا في وضع قانون متكامل للوقف الإسلامي بعد تهذيبه بالحذف والإضافة والتعديل في نصوصه ليحقق الغاية التي يهدف القانون إلى تحقيقها.
