Overview
تناولت هذه الدراسة بيان مفهوم نظرية الظروف الطارئـة وأركانهـا وشـروطها إجمالا، ثم بينت الدراسة موقف الفقهاء من فسخ عقد الإجارة بسبب حدوث ظرف طارئ واختلافهم في ذلك، ثم عرضت الدراسة لأقس ام الظرف الطارئ فثبت أنه قسمان: ما يعد مؤثرا يفسخ به عقد الإجارة، ومالا يعد مؤثرا فلا يفسخ به العقد، ثم عزز الباحث الدراسة بأمثلة تطبيقية توضح ذلك.
