انتهجت الدولة على الأراضي الموجهة للمشاريع الاستثمارية منح الامتياز عن طريق التراضي ، بموجب قانون المالية التكميلي لسنة 2011 . هذا النمط الوحيد يمنح بقرار من الوالي ، باقتراح من لجنة المساعدة على تحديد الموقع و ترقية الاستثمارات و ضبط العقار أو من هيئـة مكلفـة بتسـيير المدينـة الجديـدة إذا كـان المشـروع الاسـتثماري داخـل محيط المدينة الجديدة أو بموافقة من الوكالة الوطنية للتنمية السياحية إذا كان المشروع الاستثماري سـياحي ، بعد موافقة الوزير المختص.
