تناولت الدراسة مسألة ضمان العيوب في الفقه الإسلامي وذلك من خلال ذكر الشروط التي ينبغي توافرها في العيوب التي يمكن أن توجد في السلع المعيبة حتى تكون مضمونة، وهذه الشروط هي: أن يكون العيب قديماً، وأن يكون العيب مؤثراً ينقص قيمة المبيع، وأن يكون العيب خفياً لم يعلمه المشتري، وأن لا يشترط البائع البراءة من العيوب التي يمكن أن توجد في المبيع.
