Overview
نتيجة التطور الحاصل في العالم من القيام بمشاريع كبرى فإن مفهوم العقود الدولية للإنشاءات يمثل أهمية واسعة كبيرة في خط التنمية للدول. فالعراق اليوم يحتاج إلى مثل هذه العقود لإعادة أعمار البيئة التحتية عن طريق إنشاء مشاريع كبرى فإن العقود الدولية للإنشاءات لها أهمية لإنجاز هذه المشاريع لذا يتطلب توفير الغطاء القانوني والاقتصادي لإنجاز هذه العقود ويأتي قانون الاستثمار رقم 13 لسنة 2006 وتعدليه لسنة 2009 لتوفير الغطاء الاقتصادي لأجل التعاقد مع الشركات الأجنبية لإنجاز المشاريع الكبرى. وعليه سنتناول هذا الموضوع في ثلاث مباحث: يخصص المبحث الأول: مفهوم العقود الدولية للإنشاءات المبحث الثاني: دراسة خصائص العقود الدولية للإنشاءات. المبحث الثالث: الطبيعة الإدارية للعقد الدولي للإنشاءات.
