إن الحفاظ على السر الطبي عن طريق توفر الحماية الجزائية له، يبرره مصلحة المريض كونه يزرع الثقة في نفسية المريض، ويجعله يرتاح للطبيب مسلما له بدنه وأسراره. لقيام جريمة إفشاء السر الطبي لابد من توفر مجموعة من الأركان صفة المؤتمن على السر، وإفشاء السر، والقصد الجنائي، يرد على الجريمة بعض الاستثناءات، يجب فيها على الطبيب أن يبوح بالأسرار الطبية دون أن تقوم مسؤوليته الجزائية.
