Overview
تعد القواعد الفقهية من الكليات الشرعية التي يحتاج إليها عند وقوع النوازل، ولهذه القواعد أنواع وموضوعات مختلفة، من أبرزها قاعدة \"الضرر يزال\" والتي لها صلة مباشرة بالعديد من المستجدات، والتي منها مسألة التنويم المغناطيسي. ويهدف هذا البحث إلى بيان دورها في هذه المسألة في مبحثين: أحدهما تناول الدراسة النظرية لهذه القاعدة، ببيان معناها، وضوابطها وأحكامها، وأهم أدلتها. وثانيهما: تناول الدراسة التطبيقية على جملة من مسائل التنويم المغناطيسي. وقد انتهت الدراسة إلى أن ما ترجح فيه الضرر في استخدام التنويم المغناطيسي فلا يجوز استخدامه فيه، وما ترجح فيه النفع والفائدة جاز استخدامه فيه.
