Overview
كلما تطور القانون وتقدم كلما وجد المشرع نفسه مضطرا إلى مشاركة الإرادة في صنع العقد، وذلك بفرض المراكز التعاقدية أو ترتيب أثارها، طبقا للغايات المرجوة. ومهما كانت صور الإجبار وحدته فان القانون يضطلع بوظيفته فيتصدى لحكم سلوك الأفراد حكما ملزما، سواء بقصد تنظيم علاقات الأفراد أو بترجيح بعضها على بعض، لذا تتعدد صور الإجبار وتتفاوت فيما بينها من حيث درجة التأثير على الإرادة ومن حيث المرحلة التي يصيب العقد بها، ومن حيث الغاية التي يرسمها، فالإجبار لا يأتي على درجة واحدة، ولا على صورة واحدة ومن ثم يبدأ بالتدرج.
