Overview
يعتبر عزل الموظف العام بسبب إهمال المنصب، أخطر إجراء إداري يتعرض له الموظف العام الذي أهمل منصبه، حيث يؤدي إلى حرمانه من الضمانات التأديبية من جهة ويحرمه أيضا من التوظيف من جديد من جهة أخرى، ونظرا لذلك أحاط المشرع الجزائري عزل الموظف بسبب إهمال المنصب بجملة من القواعد الموضوعية والإجرائية، التي يتوجب على السلطة الإدارية المختصة احترامها قبل إصدارها لقرار العزل وتعد هذه الضوابط بمثابة ضمانات ممنوحة للموظف وفي حال مخالفة الإدارة لهذه الضوابط، يعتبر قرار العزل الصادر عنها باطل وعديم الأثر.
