Overview
القاعدة العامة أن التشريع من اختصاص السلطة التشريعية، إلا أن المؤسس الدستوري منح الاختصاص التشريعي للسلطة التنفيذية في مجالات معينة، فقانون حماية المستهلك وقمع الغش يمتاز بخصوصية في ركنه الشرعي كون أن المشرع تنازل عن وظيفته للسلطة التنفيذية التي أضحت تقوم بتنظيم هذا القانون وذلك بتحديد معالم التجريم فيه، مما أدى لتعاظم الاختصاص التشريعي للسلطة التنفيذية مقابل تقليص دور المشرع في هذا النوع من الجرائم.
