تهدف هذه الورقة البحثية إلى تحديد منظور الفقه الإسلامي لمؤسسة الأصل التجاري ومقارنة مفهومه في القانون بمفهوم الخلو في الفقه الإسلامي وتحديد امتداد مؤسسة الأصل التجاري في الفقه الإسلامي. وتوصلت الورقة البحثية إلى أن الأصل التجاري بمفهومه القانوني له امتداد في الفقه الإسلامي من خلال وجود مجموعة من الحقوق الإسلامية القريبة منه من حيث التنظيم والمقصد، وأن الأصل التجاري يطابق أحكام الشريعة الإسلامية ولا يخالفها في معظم أحكامه المعاصرة، وذلك من خلال استحضار جوهر الشريعة وأدلتها الكلية ومقاصدها العامة.
