Overview
لقد أحدث المشرع الجزائري آلية جديدة لاستغلال العقارات الوقفية وهو عقد الاستغلال، هذا العقد الذي تمنح بموجبه إدارة الأوقاف العقار الوقفي إلى مستثمر شخص طبيعي أو معنوي عام أو خاص، قصد استغلاله وتنميته وفق دفتر شروط يحدد حقوق والتزامات الطرفين، ويتم منح العقار الوقفي إلى المستثمر عن طريق المزايدة كأصل عام وذلك في إطار مبادئ المنافسة وتثمينا للعقار محل الاستغلال، غير أنه يمكن في حالات استثنائية منح العقار عن طريق التراضي.
