شهد التقنين الفرنسي تعديلات جوهرية على أحكام تكوين العقد متأثراً بالنظام الأنجلوسكسوني، ولم يتأثر المشرع القطري حيث ما زال متمسكاً بركن السبب والذي يشوبه الغموض وعدم الفاعلية، لذلك نسعى من خلال هاته الدراسة المقارنة بركن المقابل الوصول إلى توصيات تشجع المشرع الوطني في تعديل أحكام تكوين العقد.
