يهدف هذا البحث إلى حول بيان مدى الأثر الذي تتركه القرارات الصادرة عن المحكمة الاتحادية العليا في رسم سياسة الدولة بشكل عام، ويبرز هذا الأثر باتجاهين أساسيين الأول: تأثير الأحكام الصادرة عن المحكمة في سياسة التشريع والثاني هو بيان مدى التأثير الناتج عن قرارات هذه المحكمة على سلطة التنفيذ، ويحتل هذا الموضوع أهمية كبرى كون هذه المحكمة اعلى سلطة قضائية في الدولة والأحكام الصادرة عنها ملزمة لكافة السلطات الأخرى كما ويبين هذا البحث مدى إسهام هذه المحكمة في رسم سياسة الدولة.
