منح المشرع الدائن عدة وسائل قانونية تساعده في الوصول إلى هدفه وتنفيذ الحكم القضائي وحصوله على حقه بشكل فعلي بدءاً من تنفيذ الحكم تنفيذاً معجلاً، ووصولاً إلى الحجز على أموال المدين وبيعها، وإذا كانت مباشرة الدائن الإجراءات التنفيذ على أموال مدينه حق مقرر له بموجب القانون، إلا أن عليه أن يستعمل حقه من دون تعسف وإذا ثبت تعسفه كان مسؤولاً عن ذلك.
