Overview
يتفق شراح القانون أن الحق هو سلطة يقرها القانون لشخص على شيء، ولما كانت حقوق الملكية الفكرية بوجه عام و العلامة التجارية أحد أهم عناصر الملكية الصناعية بوجه خاص أحد أهم هذه الحقوق لكونها تنطوي على فكرة الحقوق الذهنية كونها منوطة بعقل الإنسان و هي الوسيلة لزيادة الابداع و نتيجة لهاته الأهمية المتزايدة سواء على المستوى الوطني أو الدولي أقر المشرع الجزائري على غرار التشريعات الأخرى ضرورة توفير حماية لأصحاب حقوق العلامة التجارية لهذا جاءت فكرة حماية العلامة التجارية بواسطة المعهد الوطني الجزائري للملكية الصناعية و المنظمة العالمية للملكية الفكرية.
