تبحث هذه الدراسة في مبدأ الحيطة كأساس جديد لقيام المسؤولية المدنية الناشئة عن أضرار نظم الذكاء الاصطناعي، والتي تقوم بمفهومها التقليدي على أساس جبر الضرر عن طريق تعويض المضرور، غير أنه بتطور نظم الذكاء الاصطناعي وتعقيدها ظهرت أضرار ومخاطر مرتبطة بغياب اليقين تتعذر توقعها وتقييم مدى جسامتها، فكان من الضروري القول بتفعيل مبدأ الحيطة الذي يرتكز على استباق وتوقع المخاطر، ومن ثم اتخاذ التدابير والاحتياطات اللازمة لتفديها أو الحد منها، لذا تعرضنا بنوع من التفصيل لمفهومه والشروط التي يقوم عليها، إضافة إلى جوانب تكريس هذا المبدأ في التشريع الجزائري، وإيضاح أثره على قواعد المسؤولية التقليدية، وأخيرا تطبيقه على المسؤولية الناشئة عن أضرار الذكاء الاصطناعي.
