يعمل المحترف جاهدا من خلال مزيج من الدعاية والمبالغة لجذب المستهلك الإلكتروني مما قد يؤثر سلبا على رضاه في اختيار المبيع الملائم له، ومن أجل حماية هذا الأخير عمل المشرع الجزائري على تبني حق العدول، مع أنه خروج عن المبادئ الملزمة للعقد إلا أن طبيعة العقود المبرمة والمركز الضعيف للمستهلك الإلكتروني يبرران هذه الحماية، وعليه يعد هذا الحق امتياز يهدف إلى إحلال التوازن العقدي ولكن قد يؤدى إلى عكس ذلك. تهدف هذه الدراسة إلى تبيان الإطار العام لحق العدول في مجال العقود الاستهلاكية الإلكترونية مبرزين الآثار المترتبة عن ممارسة هذا الحق، لنخلص أن حق العدول جاء كرخصة محضة حماية لمصلحة المستهلك الإلكتروني في مواجهة هيمنة المحترف إلا أن المشرع لم يحدد الإجراءات المنظمة له، بل تركها لتنظيم لاحق.
