Overview
يشكل الحق الأدبي للمؤلف جانبا مهما من جوانب الملكية الفكرية، حيث ينصب على حماية شخصية المؤلف ، وبعبارة أخرى يعتبر من الحقوق اللصيقة بالشخصية . لذلك اعترف الفقه والقضاء بعدم جواز التصرف فيه أو الحجز عليه . كما هو حق دائم يظل قائما بعد وفاة المؤلف، ولا ينتقل إلى الورثة . وهذا يعني أن المؤلف المبتكر هو من يستطيع ممارسة عناصر الحق الأدبي . واذا سلمنا بصحة هذا المبدأ إلا أنه لا يمكن القبول به على إطلاقه . فعلى سبيل المثال المصنف الجماعي وعقد العمل الذي قد يربط بين المؤلف وصاحب عمل يساهمان في تخفيف حدة هذا المبدأ.
