تهدف هذه الدراسة إلى النظر في أثر مبدأ العدل في علم أصول الفقه، لا من الزاوية الأخلاقية أو المقصدية، بل من حيث أثره في الأصول النظرية للشريعة، وانعكاسه على آليات الاستنباط ومناهج التفكير الإسلامي، باعتباره مبدأ مرجعيا تستند إليه أصول وأدوات الاجتهاد الفقهي. وقد تتبع الباحث الأدلة والشواهد الموجهة إلى مراعاة مبدأ العدل في سن الأحكام من الناحية الوظيفية، محللا عددا من اجتهادات الصحابة الأولى، ليستنبط أدلتها والمكانة الأصولية لمبدأ العدل فيها وأثره في الاجتهاد، وبما استقر لاحقا من أدوات منهجية في علم الأصول، مثل أدلة الأحكام والقواعد الأصولية.
