Overview
قد تطرأ على الدولة ظروف استثنائية تهدد سلامتها، كالحروب والكوارث الطبيعية، وتجعلها عاجزة عن توفير حماية للنظام العام باستخدام القواعد والإجراءات العادية. وفي هذه الحالة لابد أن تتسع سلطات هيئات الضبط لمواجهة هذه الظروف، وذلك من خلال تمكينها من اتخاذ إجراءات سريعة وحازمة لمواجهتها. ولما كانت الظروف الاستثنائية من شأنها المساس المباشر بحقوق وحريات الأفراد الشخصية التي يكفلها الدستور، فلابد أن يتدخل المشرع لتحديد القيود الواردة عليها. مع الإشارة على الضمانات لهذه الحريات من أجل أن لا تتعسف السلطة في إصدار قراراتها وأوامرها بهذا الشأن.
