Overview
The nature of international commercial transactions necessitates the development of a specialized system for resolving disputes in international trade. This system, known as arbitration, requires speed and flexibility. However, the main issue with this alternative dispute resolution method is that an arbitration award issued by a specific tribunal in one country can become ineffective if it is not recognized by the state required to enforce it. Therefore, this study will focus primarily on the implementation of international commercial arbitration awards, which requires their recognition. The study will also address the issue of challenging these awards under the Code of Civil and Administrative Procedure.
