Overview
تناول هذا البحث بالدراسة أثر الهيئة الاجتماعية في الأحكام الأصولية، ويقصد بالهيئة الاجتماعية انضمام شيئين، بحيث يكون لانضمامهما أثر على الأحكام مختلف عن حال انفرادهما. وتوصل البحث إلى أن للهيئة الاجتماعية تأثيرا في العديد من المسائل الأصولية، من أهمها تأثيرها في مباحث الإجماع، والأخبار، والتعليل، والترجيح، والأمر والنهي، واستنتج البحث الشروط الأولية لتأثير الهيئة الاجتماعية في الأحكام؛ وهي انضمام أمرين فأكثر؛ حيث لا تطلق الهيئة الاجتماعية على حالة الانفراد، وأنْ يكون لهذا الانضمام تأثير، بحيث لو لم يكن له تأثيرٌ فإن الهيئة الاجتماعية تسمى هيئةً اجتماعية من حيث الصورة، لكنها ليست هيئةً اجتماعية حكمًا، وقد استخدم الباحث المنهج الوصفي التحليلي لتحقيق أهداف البحث.
