Overview
يعد موضوع انحلال الزواج المختلط من أكثر المواضيع إيثارا لتنازع القوانين والإشكالات في القانون الدولي الخاص، لتشابك وتداخل العلاقات بين الأفراد على خلفية الاختلاف القائم في التشريعات، الأديان، العادات والثقافات بين الدول. وعلى غرار باقي التشريعات سعي التشريع الجزائري إلى معالجة هذه الإشكالات من خلال سن قواعد تنازع تهدف إلى تحديد القانون الأكثر ملائمة من بين القوانين المتنازعة والمتزاحمة، كما يستبعد تطبيق القانون الأجنبي متى أسند الاختصاص له، إذا خالف النظام العام أو ثبت له الاختصاص غشا.
