Overview
تعني القرينة أن الإنسان بريء حتى تثبت إدانته، ويظل كذلك إلى أن يوجد دليل كاف على أنه اقترف جريمة معينة. وبالرغم من ذلك يجوز أن يتم حبس المتهم احتياطيا على ذمة التحقيق كأحد إجراءات استكمال التحقيق الابتدائي ومن ثم يعد إجراء من إجراءات التحقيق أو لحفظ النظام العام حال خطورة المتهم، أو خشية هروبه أو ارتكابه لجريمة جديدة أو تهديده للشهود أو المجني عليهم، وفي ضوء ذلك يأتي هذا البحث ليوضح العلاقة بين قرينة البراءة والحبس الاحتياطي.
