Overview
使用归纳的方法定义“灰色版权”。描述了在哪些情况下能够最恰当的度量版权实际被保护程度的灰色地带。通过两种方法，一个是归纳定义法，即一个例子接一个例子并且一层接一层来构建术语的涵义；第二个是基于“囚徒困境”游戏的精神的行为实验法。从而发现在灰色版权的例子中，决定灰度的因素不在于其法律地位，而是其执行使用权的经济价值。并在实验中，学生有机会获得参与到侵犯版权行为中的风险和选择的个人感知。通过以上分析把重点从合法性和不合法性的论题转移到了潜在侵权者和版权持有者准备采取行为的经济风险性问题上。
