Overview
يسلّم هذا البحث بأن الانسان محور الاهتمام في أيّة حضارة. فيسعى، على هذا التسليم، إلى النظر في الحضارة الإسلامية التي توسم بأنها حضارة فقه، من حيث اعتبار الإنسان المكلّف وتقديمه والاحتفال به عند الكشف عن المقاصد، مع الاقتناع بأن مراعاة أحوال المكلفين وقدراتهم هي السبب في اختلاف الأدلة الشرعية وليس تفاوت أنظار المجتهدين المقاصديين. ويسلك البحث مسلك المجادلة بين القواعد المصوغة في أحكام المكلف في علم الأصول، ومطلق النظر المأذون به في القرآن الكريم. ويصل إلى استنتاجات مبنية على نتائج تلك المقابلات تعود على قواعد معرفة المقاصد بالاستفهام.
