يعتبر عقد الزواج مجالا خصبا لتنازع القوانين، متى ما كان أحد طرفي العلاقة أجنبيا، حيث يرتب مجموعة من الآثار الهامة والخطيرة، وأمام هذا الوضع تثير هذه الآثار إشكالات عدة، وأهم إشكال يتمثل في معرفة القانون الواجب التطبيق، وكذا تحديد ما يدخل ضمن أحد قسمي هذه الآثار، انطلاقا من أن أثار عقد الزواج المختلط نوعان: أثار شخصية وأخرى مالية.
