Overview
يتناول هذا البحث قضية فقهية لها بعد تربوي استوقفت الباحث في مجال رعاية الأيتام، وهي مسألة (أمد كفالة اليتيم) هل إذا بلغ اليتيم الحلم تتوقف الكفالة عنه وأجرها عن كافله أم بلوغه مرحلة الرشد والقدرة على الاستقلال وإدارة شؤون نفسه؟ وتوصل الباحث إلى أن هذه المسألة لم يتطرق إليها الفقهاء المتقدمين بشكل صريح، ومن مجموع المسائل المتعلقة بكفالة اليتيم استنبط أن أمد الكفالة ممتدا إلى بلوغ اليتيم مرحلة الرشد، وليس هناك أي دليل معتبر لتوقف الكفالة عند بلوغ اليتيم الحلم.
