Overview
تناول البحث بالبيان الارتباط بين قاعدة العادة محكمة ومقاصد الشرع؛ ليسهل بذلك فهم الغايات المرجوة من التشريع فيما يعتد فيه بالأعراف، واعتمد الباحث المنهج الاستقرائي والتحليلي والوصفي، وتوصل من خلال ذلك إلى النتائج الآتية: 1-وجود ارتباط وثيق بين قواعد الفقه ومقاصد الشرع. 2-قاعدة \"العادة محكمة\" يتم بها تحديد الأمور غير المنضبطة. 3-الاعتداد بأعراف الناس من يسر هذه الشريعة الغراء. 4-الإحالة على الأعراف ليس مطلقا، بل يتعلق بالجانب المرن من التشريع.
