Overview
The lack of legal and policy clarity around current expulsion policies in the context of migration control is striking. This article argues that this lack of clarity is, however, not accidental: the outsourcing of migration enforcement to private non-state actors has both enabled and accelerated the normalization of expulsions as an acceptable and preferred form of migration control. The increasing involvement of these actors in the business of privatized migration enforcement raises concerns in terms of legal responsibility, as evidenced by the 2014 International Law Commission Draft Articles on the Expulsion of Aliens. It also reinforces externalization and containment measures which not only rely on the normalization of detention and expulsion, but also on informal cooperation on readmission; 'voluntary' returns; and the use of development aid and finance in order to fund migration responses.
